Is there a Bill of Rights for nursing home patients?


A: Many states have nursing home patient bill of rights. The federal government also passed a law that applies to nursing home patients. The law is sometimes referred to as the Federal Nursing Home Reform Act or as OBRA 1987 or as the Omnibus Budget Reconciliation Act of 1987. Regardless of how you call it, that federal law mandates federal standards for nursing homes that receive Medicare or Medicaid funding-which is virtually all nursing homes. Unfortunately, many nursing homes are more interested in profit than they are in the quality of life and care of their patients. That is true despite the Federal Nursing Home Reform Act.
