I bought a car and now the dealer is calling me saying I have to bring the car back because my financing didn't go through. Do I have to take my car back to the dealer?

 

A: That depends is the best answer that can be given without much more information. You may be the victim of a classic form of auto fraud commonly referring to as a Yo-Yo sale. That is where the sale was consummated but the dealer can't find someone to sell the financing to and the dealer wants you to agree to a higher interest rate or higher selling price. Often, the dealer refuses to give you back your trade-in. Such would probably be fraud. On the other hand, it is possible that the contract you signed allows the dealer to get the car back, but even then it would have to return your trade-in to you. The best answer is to contact an auto fraud attorney to see if you have been the victim of fraud.
