Our client was a diabetic, which caused him to develop peripheral neuropathy which made it so he had virtually no feeling in his lower legs or feet. While he was up one day doing his daily walk, he stepped on a needle that had been left on the floor by the nursing home personnel. He end of the needle broke off in his foot. The needle could not be removed without surgery. He was transferred to a local hospital. Due to bad circulation, it did not heal very quickly so the physician ordered whirlpool therapy to aide in the healing process. While in the whirlpool, the nurse left him alone and apparently forgot he was in the whirlpool. After over an hour of calling out with no response, our client decided to try to get out of the whirlpool by himself. Unfortunately, while doing so, he slipped, fell and broke his hip. Several months later, he passed away having never fully recovered. The state medical examiner stated that the official cause of death was septicemia. Thus, the defense attempted to claim that his death was not related to the needle or the fall. After analyzing the medical records however, we were able to show the medical examiner that his earlier opinion on the cause of death was inaccurate. He changed the official death certificate to reflect the fall. Thereafter, the case quickly settled for a confidential amount.
