Our client was driving his minivan with his wife and several of his grandchildren in the back. He was stopped at a stop light in Lawton, Oklahoma. Suddenly they were struck from behind. Several were hurt. The driver of the car that hit them did not receive a scratch. The police and ambulances arrived. The injured were taken to the hospital and the police noticed the lady that caused the accident smelled of alcohol. She was taken to the police station where her blood alcohol was tested. Despite her deposition testimony, the insurance company still claimed that it was our client's fault. Under Oklahoma law, our client could not sue the lady's insurance company. However, understanding the intricacies of Oklahoma insurance law, we were able to posture the case where the insurance company was in trouble. On the day before the trial was to begin, the insurance company agreed to pay twice its policy limits!
