Financing didn't go through after purchase of car

Our client was a sweet lady of Korean decent who was married to an Army soldier who was fighting in Iraq.  She received in the mail an advertisement from an auto dealership stating that “everyone is qualified” regardless of good credit, bad credit, no credit, bankruptcy . . . You’ve probably seen similar advertisements.  She was all alone with her husband overseas and she was concerned that her car was not as reliable as it used to be.  She was concerned that if it broke down, there would be no one to help her.  So she decided to go to the dealership to see what the ad was all about.  When she arrived, she told the salesman that she was interested in reliable and economical transportation—an economy car.  The salesman was intent on selling her a luxury car.  He reminded her that “everyone is qualified” and he could put her in the new luxury car.  She told him the amount of monthly payments she could afford (a guaranteed mistake) and he said he could put her in the luxury car for those payments.  She agreed, she signed the papers, gave him the keys to her trade-in and drove home in her new luxury car.  Her friends were impressed.  She was proud of how she had handled the situation without her husband’s assistance.  About ten days later, she received a call from the salesman.  The financing didn’t go through and she would have to bring the new car back to the dealership.   Disappointed and rather embarrassed, she complied with his request.  At the dealership, she said that she just wanted her old car back.  However, the salesman gave her the news:  they had already sold her trade-in so she would have to buy something else.  That is a classic case of auto fraud.  She came to hire us.  Eventually, the matter was worked out to her satisfaction.  Don’t let auto dealers commit this type of fraud on you!
