This is another "duel-insured" case. A duel insured case is one where both vehicles involved in the accident are insured by the same insurance company. It creates many unusual and complicated issues. Our client was driving her minivan with her child in the back seat. A car leaving a casino suddenly tried to cross the street. Our client tried to avoid a collision by veering away. Unfortunately, she lost control of the minivan and it flew down an embankment landing upside down about 30 feet below. Both were severely injured. The insurance company assigned two adjusters to the case: one on the other car's policy and one on our client's policy. The only way the insurance company could get out of paying on this accident was to claim that the accident was our client's fault by overreacting. So, that is exactly what happened. Our client's adjuster determined that the accident was the fault of the other driver-which means the company has to pay. The other car's adjuster determined that it was our client's fault by overreacting to the car that was about to hit her broadside. In secret e-mails not contained in the claims files, the insurance adjusters exchanged ideas on how to get out of having to pay. They decided that if both of them claimed it was our client's fault the insurance company would have no one to pay. It wouldn't have to pay the other vehicle because it wasn't hit. It wouldn't have to pay my client because it was her fault. So the insurance adjuster changed her opinion and decided it was our client's fault and the claim was denied. By the time we had finished with the insurance company, it had paid for all of our client's damages plus over twice the original policy limits.
