Our client who lived in Texas, had come to Oklahoma because her daughter was about to deliver her baby. She wanted to be there for the birth. Just over a week after the birth, the family decided to take our client-the new grandmother-back to her home in Texas. While driving on Interstate 40, the father fell asleep and hit the vehicle in the lane next to their automobile. The car then went out of control and crossed the center median and was crossing the opposing lane of traffic when it was hit by a semi-truck. The mother, father and baby were killed instantly. The grandmother survived. After a great deal of investigation, it was discovered that the semi-truck was speeding at the time of the accident and the driver had violated federal law regarding his logs, the truck's brakes, other items. Our investigation revealed that the truck was traveling in excess of 80 miles per hour. The trucking company tried to claim that it was impossible for the truck to have been speeding since the truck was equipped with a governor that prevented the truck from exceeding 55 miles per hour. However, we were able to obtain copies of the purchase order for the semi-truck from its manufacturer, which showed that the governor was specified to be set at 80 miles per hour. The case settled before trial for the policy limits of $1,000,000.00.
